Terms of Service

These terms govern your use of CraneIQ — the software, mobile applications and website at craneiq.com.au (together, the "Service") — operated by CraneIQ ("we", "us"). By creating an account or using the Service you agree to these terms on behalf of yourself and, where applicable, the company you represent.
1. Your account
You must provide accurate information when registering and keep your login credentials secure. You are responsible for activity under your account. Company administrators are responsible for the users they add or invite to their company workspace.
2. Free trial
New companies receive a free trial (currently 30 days, no payment details required). At the end of the trial your workspace becomes read-only unless a subscription begins. We retain trial data for at least 90 days after expiry, after which it may be deleted.
3. Subscriptions and fees
Paid plans are charged per active crane per month as published on our pricing page or as otherwise agreed in writing. Fees are in Australian dollars and exclusive of GST. Monthly subscriptions may be cancelled at any time effective at the end of the current billing period; annual subscriptions run for their term. We may change pricing with at least 30 days' notice; changes apply from your next billing period.
4. Your data
Your company's data — jobs, fleet, crew records, clients, rates, documents — belongs to you. We access it only to operate, support and improve the Service. You can request an export of your data at any time. Our handling of personal information is described in our Privacy Policy.
5. Acceptable use
You agree not to misuse the Service, including attempting to access another company's data, reverse engineering the software, reselling access without our agreement, or using the Service in breach of any law.
6. Safety-critical information
CraneIQ provides planning, scheduling and reference tools, including lift calculations based on manufacturer load-chart data. These tools support — but do not replace — the judgement of licensed, competent personnel. You remain solely responsible for verifying lift plans, crane configurations, load charts, site conditions and regulatory compliance before any lift is performed. To the maximum extent permitted by law, we are not liable for loss arising from reliance on the Service in place of proper engineering and operational judgement.
7. Availability and support
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, and we will use reasonable efforts to give notice of planned downtime. Support is provided by email at support@craneiq.com.au.
8. Liability
Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law. Subject to that, the Service is provided "as is", and our total liability arising out of or in connection with the Service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential loss, including loss of profits or data, to the extent permitted by law.
9. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that breach these terms or where fees remain unpaid after reasonable notice. On termination we will make your data available for export for at least 30 days unless the law requires otherwise.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified via the Service or email at least 14 days before taking effect. Continued use after that date constitutes acceptance.
11. Governing law
These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
